New Overtime Rules: Current Status

As you may have heard, a federal judge has issued a preliminary injunction on the Department of Labor's new overtime rules. What does this mean?

Here are the basics:

  • The effective date of the rules has been delayed indefinitely.
  • Employers may choose not to immediately implement the changes they'd planned for Dec. 1 compliance.
  • The new rules haven't been thrown out or invalidated - just put on hold.

At this point, we don't know how long the injunction will be in place, if the rules will eventually be thrown out or if the final decision will allow some parts of the rule to stand and not others.
