Pass the 'ABC' Test to Ensure Contractors are Properly Classed

The ABC Test is a legal framework used by many states to determine whether workers are classified as employees or independent contractors. This test has become increasingly significant and is considered more stringent than traditional common law tests.  

What is the ABC Test?

Under the ABC Test, a worker is presumed to be an employee unless the hiring entity can demonstrate that all three conditions are met.

The first condition requires that the worker be free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract and in reality. The second condition mandates that the worker performs work outside the hiring entity's usual business course. The third condition requires that the worker be customarily engaged in an independently established trade, occupation, or business similar to the work performed. 

To pass the ABC Test, businesses should carefully evaluate the nature of the work performed by contractors and freelancers relative to the company’s core business activities. It is crucial to ensure that independent contractors have the autonomy to determine how they complete their work. Verifying that contractors have established their independent businesses or provide services to multiple clients further supports proper classification.
